Wrongful Death
Wrongful death is any death that is a result of the negligence,
carelessness, recklessness, or even accidental action by another
individual or corporation. As you can imagine, quite a broad number
of human actions or errors may qualify except perhaps dying
in your sleep. But let's examine even that one. Your friend goes
to the Emergency Room of a local hospital. He is given three
medications, which he begins taking as the doctor ordered.
He dies in his sleep that night. If an investigation of the facts
reveals that the patient should not have been prescribed those drugs
or that all three should not have been administered simultaneously,
his estate would have a good case. There are many other examples.
The next of kin of the deceased – wife, children, parents (the estate)
– obtains monies awarded on wrongful death cases.
Surprisingly, most people are not aware of that.
